Resumo:	A Corte Africana de Direitos Humanos e dos Povos foi criada para garantir que os Direitos Humanos fossem assegurados entre os povos do continente africano. Por meio dos acordos internacionais, são instituídos tratados em que constam as obrigações a serem assumidas pelos Estados para que tal objetivo seja alcançado. Nesta direção, o presente trabalho teve como objetivo analisar as decisões prolatadas pela Corte Africana de Direitos Humanos e dos Povos, como as decisões do Tribunal Supremo da República de Angola a fim de fazer uma comparação entre a proteção garantida por este país e a proteção garantida pela Corte Africana em relação aos direitos e bem-estar da criança africana. Tem-se, principalmente, como objetivo, verificar se há ou não a salvaguarda dos direitos humanos das crianças em Angola, ainda que o país não tenha ratificado os tratados no âmbito da Corte Africana. Assim, o trabalho foi desenvolvido a partir de uma pesquisa que faz uso de elementos quantitativos e qualitativos, sendo adotado o método hipotético-dedutivo desenvolvido por Karl Popper, cuja hipótese para a pergunta de pesquisa será testada com elementos coletados do mundo da vida em prol do seu falsificacionismo. Além do mais, foi feita a coleta das decisões da Corte Africana dos Direitos Humanos e dos Povos e do Tribunal Supremo da República de Angola que versam os temas ligados aos direitos das crianças. Os dados empíricos foram confrontados com uma revisão de literatura e de documento. Analisamos a Corte Africana de Direitos Humanos e dos Povos para em seguida ser feita uma análise crítica sobre os direitos e bem-estar da criança. Por fim, foram examinados os direitos das crianças em Angola fazendo uma compração com as decisões do Tribunal Supremo da República de Angola e da Corte Africana de Direitos Humanos e dos Povos. Como resultado foi possível constatar que a capacidade da Corte Africana de proteger os Direitos Humanos e dos Povos ainda é restrita e que os casos de violação de menores de 12 anos ocupam um lugar de destaque nos tribunais angolanos, já que são crescentes os números apresentados nas últimas décadas.
Abstract:	The present work aims to analyze the decisions issued by the African Court of Human Rights and the peoples, such as the decisions of the Supreme Court of the Republic of Angola to compare the protection guaranteed by Angola and the protection guaranteed by the African Court in relation to rights and Wellness of the African child and especially to verify whether or not there is a safeguarding of children's human rights in Angola, even though Angola has not ratified those treated within the African Court. In the first chapter, we addressed the literature review and the methodology adopted in a thorough way for the construction of the present work. In the second chapter, the main historical aspects of the creation of OAA, the change from OA to UA, about the creation of the African Charter of Human Rights and the Peoples and the African Commission on Human Rights, created through the African Charter of Rights Humans and the peoples. In the third chapter it was the African Court of Human Rights and the peoples. Already in the fourth chapter, we seek to perform a critical analysis of the rights and well-being of the child, the rights of children. Finally, in the last chapter it is intended to analyze the rights of children in Angola and compare the decisions of the Supreme Court of the Republic of Angola and the African Court of Human Rights and the peoples. The work will use a complementary analysis, both quantitative and qualitative, consisting of the following techniques: theoretical research (literature review) for the purpose of verifying the state of the art and forming a lens by which the data will be read/interpreted; legal-diagnosis, given that it is intended to analyze the decisions of the African Court of Human Rights in the light of the rights and well-being of children; Projective and legal-interpretative legal and legal.
